Transcend Financial Group (“Transcend,” “us” or “we”) provides this privacy notice (“Notice”) to describe Transcend’s policies and practices that govern the use, collection, maintenance, protection, and disclosure of your personal information.  We may collect personal information from you when you visit our website, which may include www.transcendfinancialgroup.com and all subdomains, engage us to provide services to you, use or access any of our applications or software, attend one of our seminars or classes, or otherwise communicate directly with Transcend, (each individually a “Service”, and collectively the “Services”).

By using any of the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Notice.  If you do not agree to the terms of this Notice, then discontinue your use of the Services immediately. 

We review our policies and practices on an ongoing basis, which may result in changes to this Notice from time to time.  If such changes are material or significant, we will indicate the changes on the homepage of our website and may directly notify our clients of the changed Notice.  Your continued use of any of the Services after Transcend makes changes to this Notice constitutes your agreement to the changes in the Notice.

Personal Information Collected by Transcend

Personal Information is any information that identifies you as a person as defined under the laws of the jurisdiction in which you reside.  Transcend may collect the following categories of Personal Information:

  • Contact Information. Contact information may include name, mailing address, e-mail address, telephone number, identification numbers, including social security number, state identification card, driver’s license, passport number, IP address, and Transcend website log-in information.

The above categories are exemplary and non-exhaustive.  Personal Information may qualify as sensitive information as that term is defined under applicable law.  References to Personal Information include sensitive information.  Sensitive information is treated in accordance with applicable law.

How Transcend Collects Your Personal Information

Transcend may collect Personal Information when you fill out applications or forms provided by Transcend, when you engage the Services of Transcend, when you provide the information directly to a Transcend representative, when you visit a Transcend website, or when you authorize your representative to provide Personal Information to Transcend.  In no event does Transcend obtain Personal Information about you from a third party without your authorization. 

The Information Transcend collects automatically helps Transcend to improve the Site and to deliver a better and more personalized service to Site users, including recognizing you when you return to a Site, and storing your Site-specific preferences.

How Transcend Uses Your Personal Information

Transcend may use your Personal Information to provide information or Services that you request, to improve the Services, to conduct certain aspects of our business, to comply with our legal obligations, and as permitted by law.

Transcend may disclose your Personal Information to provide you the information or Services that you request, to improve the Services, to comply with our legal obligations, and as permitted by law.  Regarding sensitive information, Transcend only discloses your sensitive information to provide you the information or Services that you request, to comply with Transcend’s legal obligations, and as permitted by law.

Disclosures to provide the Services and to improve the Services

In providing the Services, Transcend may disclose your Personal Information to (i) your authorized representatives, financial professionals, medical professionals, legal professionals, credit agencies, securities professionals, insurance professionals, tax professionals, and other professionals, in each case as authorized by you; and (ii) third parties for purposes of providing elements of the Services on behalf of Transcend, including information technology service providers, software providers, application providers, website hosting, cloud service providers, and communication services providers, such third parties use Personal Information only for the purposes for which Transcend discloses it to them.

Disclosures to comply with legal obligations or as permitted by law

Transcend may disclose Personal Information to (i) government or regulatory agencies as required by law; (ii) to legal professionals to comply with any court order, law, or legal process or to enforce its rights or the rights of a third party under the relationship; and (iii) to those required or permitted under law.

Transcend does not sell your Personal Information.

Non-Personal Information Collected by Transcend

Transcend may collect information that does not identify you or cannot be associated with you, including aggregated and anonymized information, such as website analytics, internet connection information, and device statistics.  This information is used to improve the website and other aspects of the Services and Transcend may disclose such information without restriction.

Dealing with Transcend Anonymously or using a Pseudonym

It may be possible to contact Transcend to make a general inquiry about the types of services Transcend offers without providing Personal Information.  However, it is not possible to engage the Services without providing Personal Information to Transcend. 

Retention of Personal Information

Transcend retains your Personal Information for the longer of (i) any time period required by applicable law; or (ii) any period for contesting the settlement of your estate has lapsed in accordance with the probate laws of the jurisdiction governing your estate.  Transcend treats all Personal Information retained in accordance with this Notice.     

Your Rights

Transcend takes reasonable steps to ensure the Personal Information collected is accurate, up-to-date, and complete.  As provided under applicable law, you may have the right, free of charge, to:

  • Request access to, or a copy of, your Personal Information;

  • Request correction of the Personal Information Transcend holds about you;

  • Request that Transcend delete or remove any Personal Information it has about you;

  • Object to or request a restriction to processing; and

  • File a complaint with the relevant authority in your jurisdiction.

Transcend may take reasonable steps to confirm the identity of the requestor.  Only to the extent permitted under applicable law, Transcend may charge a reasonable fee for administrative costs associated with a request.   

Transcend may deny a request related to your rights if Transcend believes the request would violate any law or legal requirement or cause the Personal Information to be incorrect.  Transcend will notify you of any denial.

Data Security

Transcend maintains appropriate safeguards in place to protect the security, confidentiality, and integrity of your Personal Information.  Safeguards may include administrative, physical, and electronic safeguards to protect against the unauthorized access, disclosure, alteration, destruction, loss, or misuse of your Personal Information.  Transcend limits acess to your Personal Information to our employees and third parties necessary to provide the Services to you. 

The transmission of information via the Internet is not completely secure and Transcend cannot guarantee the security of your Personal Information. You understand that you are providing your Personal Information to Transcend at your own risk. Transcend is not responsible for failure or circumvention of any privacy settings or security measures Transcend may have in place to protect your Personal Information.

Minors

The Services are not available to or intended for use by minors and Transcend does not knowingly collect Personal Information from minors.  The personal Information you provide may contain information about minors, and by providing such information to Transcend you consent to the collection and use of such information for the purposes of providing the Services to you.  If you are under the age of 18, you may not use any Service or provide any information through any Service unless you have parental consent that has been verified by Transcend.
